General Terms and Conditions of Business (GTC)

1. Area of applicability

These General Terms and Conditions („GTC “) apply to contracts concluded between Bühler electronic GmbH and customers in the meaning of section 13 I German Civil Code of the online-shop with the URL („WebShop “).

2. Contracting party

3. Offer and Conclusion of contract

In our webshop, we make a non-committal offer to you for the goods represented in the shop. Errors excepted.

The conclusion of contract can be carried out in German or English.

You can view the General Terms and Conditions at any time by using your internet browser, save them to your computer or print them out.

An electronic order is placed once the customer has agreed to the General Terms and Conditions and clicks on the button “Buy”.

Of course, you can always take articles out of the shopping cart again. Before you send off your order, you can check the order details and correct possible input errors. Sending off your order (e.g. by clicking on „Buy“) is your binding commitment to acquiring the shopping cart content from us.

Your order is executed and forwarded to us. Bühler electronic GmbH will immediately confirm receipt of your order via E-mail.

4. Your Right of Cancellation

4.1 Right of Cancellation
You have the right to cancel this contract without giving any reasons within fourteen days. The cancellation period is fourteen days starting on the date you or a third party named by you, not the carrier, take/takes delivery of the goods.

In order to exercise your right of cancellation, you must submit an unambiguous declaration addressed to:

(e.g. in a letter, by fax or email) informing us about your decision to cancel this contract. You can use the model cancellation form. However, its use is not mandatory. The cancellation period is deemed to have been observed if you send the communication exercising your right of cancellation within the cancellation period.

4.2 Consequences of cancellation
If you cancel the contract, we are obliged to refund all the payments we have received from you, including the delivery costs (with the exception of any additional costs in the event that you chose a delivery method differing from the standard, cheapest delivery method offered by us) without delay and within fourteen days of the date we receive your communication notifying us about your cancellation of this contract.

We will carry out this refund using the same means of payment that you originally used for the transaction unless we explicitly agreed otherwise; in no case will any charges be passed on to you due to this refund. We are entitled to refuse the refund until the gods have been returned to us or until you have furnished proof that you have returned the goods, whichever of the two falls earlier. You must return or hand over the goods without delay, in any case within fourteen days of the date on which you notify us about the cancellation of this contract to us. The deadline is deemed to have been observed if you dispatch the goods before the expiry of the fourteen day period. You bear the direct costs of returning the goods.

You are only obliged to cover the costs of any loss in value of the goods if this loss in value is the result of handling on your part beyond what is necessary to ascertain the nature, properties and functioning of the goods.

Important restrictions for kits and books:

There is no right of cancellation in the case of kits, if the kits are assembled completely or partially.

There is no right of cancellation in the case of books, if the books are unsealed by removing the plastic wrapping.

5. Prices and shipping costs

The EURO prices quoted in the web-shop include the currently applicable German Value-Added Tax (VAT). In non-EU countries we deliver exempt from VAT. All delivery costs must be paid by the purchaser calculated in accordance to the destination country. Download the table of delivery costs.

6. Delivery

6.1 We deliver stocked articles within a period of approx. 5 to 7 workdays following receipt of your order.

6.2 We deliver worldwide.

7. Payment

7.1 The payment when ordering through our web-shop, is either cash in advance or PayPal.

7.2 When selecting the payment cash in advance, please refer to the order confirmation for our bank details, which you will receive by e-mail. Additionally you can find our banking connection on the page Impressum.

8. Retention of title

Until full payment the goods remain our property.

9. Warranty

Warranty is assumed in accordance with legal regulations.

Without precluding any of your rights which you might have against Bühler electronic GmbH in any way, we generally advise you to claim compensation for damaged consignments from the forwarding agent immediately upon arrival and to have such claims confirmed in writing.

As we have no influence to the proper and correct assembly we have to limit our warranty to the completion of the supply and the faultless quality of the components.

10. Return of goods because of cancellation of contract, warranty or test / repair

10.1. Return of goods because of cancellation of contract:
If you want to withdrawal your order and return the purchased goods within 14 days please proceed in strict accordance to the chapter ”4. Your Right of Cancellation”.

10.2. Return of goods because of warranty:
If you want to reclaim and return components within the 24 month warranty-time please contact us prior to the return of the consignment by telephone during our Hot-Line times or write us an e-mail (our contact details can be found at section ”2. Contracting party”). This is required to avoid operating- or application errors.
Return the components always postage free to us because we will not accept any shipment with freight unpaid. Attach to the returned components a short description of the complaint for each component and you detailed contact details. If it will be a case of warranty we will credit the shipping cost with a credit note for benefit to your customer account. In this case you will receive your following order postage free.
If there will be proofed to be no case of warranty we will be obliged to charge the costs for testing and/or repair (see 10.3) and the fee for postage to your account.

10.3. Return of goods because of inspection / repair:
If you want to return components for inspection / repair please return the components always postage free to us because we will not accept any shipment with freight unpaid. Attach to the returned components a short description of the complaint for each component and your contact details.
We will charge for a repair a gross payment of 35€ per hour plus cost of material. If the cost of repair will show to be inefficiently and will exceed the new retail price, we will inform you accordingly and in advance. If the complained component will show no malfunction, we will charge you for the test a flat rate of 10€.

11. Applicable Law

These delivery and payment conditions and the respective legal relationship between Bühler electronic GmbH and the customer are subject to the applicable laws of the Federal Republic of Germany.

12. Separability Clause

If certain terms of these delivery and payment conditions are made inoperable or become inoperable, the validity of the other terms as well as the content of individual contracts concluded on the basis of these delivery and payment conditions remain unaffected.
